How States Should Approach Immigration

On Wednesday, the Supreme Court will consider whether Arizona’s approach to illegal immigration clashes with federal law. Alabama has also run into controversy. How can states address their concerns about illegal immigration, without overstepping their power?

1) Arizona Shows What Not to Do
If the justices uphold this statute, they will erode the ideals of racial equality, opportunity and inclusion that many Americans cherish.

A less-noticed section of S.B. 1070 allows the state to detain illegal aliens, when the federal government declines to.
 
3) The Constitution Settles It
Our federalist system provides for state innovation in many areas, but not immigration.
 
4) Let States Experiment
The federal government can take a hands-off approach or limit states, but it shouldn't do both.
 
5) For a Start, Enforce Existing Laws
Concerned about public safety? Enforce criminal laws. Concerned about workplace violations? Protect all workers' civil rights.
 
6) In Texas, the Voters Will Take Charge
Lawmakers are comfortable with the status quo, but citizens are not. Ballot initiatives will allow greater enforcement.
